  Alternative Dispute Resolution (ADR), also known as “Appropriate” Dispute Resolution offers an alternative to settling disputes by litigation through the courts. The principle ADR processes used to assist in the resolution of conflicts are Arbitration and Mediation.

Arbitration is a process whereby parties in dispute may submit their disagreement to an impartial arbitrator. Such an arbitrator is empowered to evaluate the case by considering all relevant representations, then making a final and binding determination or award, based on the merits of the case.

Mediation is a process of structured negotiations, where a neutral mediator helps the disputing parties in reaching a settlement themselves. The mediator assists the parties in evaluating their claims and facilitates the reduction of their differences to common ground. Mediators do not have the authority to make an award, or, impose a binding settlement on the parties.

ADR provides many advantages to those who wish to utilize it. Prompt scheduling, privacy, confidentiality, flexibility, economy, finality and in situations where future contact between disputants is important, the preservation of a positive business relationship.
